Consumer Guarantees Act 1993

Where the provisions of the Consumer Guarantees Act 1993 apply, these terms will be read subject to the application of that Act, and in the case of any conflict, the provisions of that Act will apply.

Stock Availability

If an item is out of stock, we will email you within 2 working days of placing your order. Please email authenticpounamu@ngaitahu.iwi.nz to check stock availability if delivery of your order is urgent.

Custom sales tax and duty

It is the responsibility of the person purchasing to be aware of the Sales and Duty Tax regulations for the country where their purchase is being delivered. As each country has different regulations and Ngāi Tahu Pounamu is not responsible for any payments for Sales and Duty Tax, which the parcel may incur upon arrival.

Insurance

All international deliveries are sent fully insured. The cost for this has been included in the International Delivery charges.

Currency

All purchases are in NZ$. International transactions are processed though the international banking system and exclude New Zealand Goods and Services Tax (GST) of 15%. Your final bill will be determined by the exchange rate applied by your credit card company at the time the charge is recorded, plus any fees applied by your credit card provider.

Availability

Stock has been specifically allocated to www.ngaitahupounamu.com and stock levels are adjusted automatically.  Queries about stock can be emailed to authenticpounamu@ngaitahu.iwi.nz 

Prices of products, services, delivery and other charges displayed on this website are current at the time of issue, but these may change at any time. The availability of our products and services may change from time to time.

In the event a particular product is sold out, Ngāi Tahu Pounamu reserves the right to either process partial orders or make refunds, or return orders in their entirety.

Ordering Goods

Orders can only be placed by people or organizations with full legal capacity to engage in a binding contract. Any order placed by you via www.ngaitahupounamu.com is an offer by you to purchase a particular product or service for the price(including delivery and other charges) specified on our website at the time you place your order.

Ngāi Tahu Pounamu reserves the right to accept or reject your offer for any reason, including, without limitation, the unavailability of any product description posted on this website, an error in your order or a failure in your payment.

Your ability to purchase products and services from ngaitahupounamu.com may be terminated at any time by Ngāi Tahu Pounamu without notice.

Order Notification

Upon receipt of your order, Ngāi Tahu Pounamu will issue you with an e-mail notification listing the items ordered, the total quantity of product, shipping charges, delivery address, estimated shipping times, and shipping carrier. This will not include any customs duties, local taxes or bank fees. This is a confirmation that we have received your order, not a confirmation of acceptance or processing.

You will receive a second email when your order has been shipped and is in transit to you. This email will include a tracking number for your reference.

Cancellations

You may cancel your order at any time prior to acceptance and processing, but please note that orders for products that are held in stock will be processed immediately and cannot be cancelled.

Jurisdiction

Ngāi Tahu Pounamu is based in Christchurch, New Zealand, and operates within normal laws of commerce under New Zealand business law. The normal laws of international commerce apply to international transactions, provided that any contract made between you and Ngāi Tahu Pounamu shall be construed, applied and shall take effect as a contract made in accordance with the laws of New Zealand and will be governed by and must be performed according to that law.

Privacy and Security

All information submitted to Ngāi Tahu Pounamu is processed and stored using secure socket layer (SSL) software, which is among the best software available for secure transactions. SSL encrypts all of your personal information so that it cannot be read as the information travels on the Internet.

Returns and Exchanges

If for any reason you are not satisfied with your purchase, please email Ngai Tahu Pounamu authenticpounamu@ngaitahu.iwi.nz within 5 working days on receipt of goods. We are more than happy to offer full refunds, or an exchange for credit.

Please return the goods together with your receipt within 30 days of receipt so we can process a refund or an exchange of equivalent value. Delivery and handling charges are not refundable. Ngai Tahu Pounamu will not accept partial refunds/ exchanges nor will it issue partial refunds/exchanges, you must return the entire order to receive a refund/exchange. Refunds will not be processed until the goods have been returned to our office.

We dont not hold any responsibility for any item/items dammaged or broken after you have received your order. We are only held accountable if your item/items are damamged or broken in transit.  

To return your product, use the reverse side of your invoice to let us know why you made this decision, and your desired resolution (replacement, refund, or exchange) for each item.

For your protection, we strongly recommend that you return your order with an insured mail service and keep the receipt for your records. Ngai Tahu Pounamu is not responsible for lost return shipments.

All refunds will be credited in New Zealand dollars and Ngai Tahu Pounamu Limited are not liale for any bank fees from your bank when processing your refund.
